Google and Epic Games reach agreement

Google and Epic Games have taken a significant step toward ending their years-long legal battle in the United States (US). The two tech giants have submitted a joint settlement proposal to the court, which includes changes to how Android and the Play Store operate. This proposal could resolve the long-running dispute over Google Play.

Sameer Samat, Head of Google’s Android Ecosystem, released a statement on the social media platform X. Samat stated that the proposed changes focus on increasing developer choice and flexibility, lowering fees, and encouraging greater competition. Samat also emphasized that they will continue to protect user safety in the process. He added that if the proposal is approved, existing lawsuits will be resolved. A hearing on the matter is scheduled for Thursday.

Epic CEO Tim Sweeney also described Google’s proposal as a “great” and “comprehensive solution” in a post on X. Sweeney stated that this proposal strengthens Android’s vision of being an “open platform.” He emphasized that the proposed changes would facilitate global competitive store installs, reduce Play Store service fees, and allow third-party in-app or web payments. These were key points Epic had long demanded.

Sweeney added that Google’s actions contrasted with Apple’s closed ecosystem, which “blocks all competing stores.” The legal battle between the two companies began in 2020 when Epic Games added its own payment system to its game Fortnite to circumvent platform fees. Following this move, Fortnite was removed from the Google Play Store.

The joint proposal submitted to the court would give developers greater flexibility to distribute apps and receive payments outside of Google Play. This flexibility covers both in-app payments and external web links. Furthermore, Google would reduce its service fees on the Play Store. The proposal sets the maximum service fee Google can charge at 9% or 20%, depending on the transaction type. The settlement also resolves a separate lawsuit Epic filed against Samsung. This comprehensive settlement proposal now requires approval from US District Judge James Donato to take effect. Judge Donato oversaw Epic’s 2023 lawsuit against Google, which forced significant Play Store reforms last year.
